1. Acceptance of Terms

By accessing or using MetaFy (“the Service”), available at https://metafynow.com and through our iOS and Android applications, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MetaFy is an AI-powered metabolic health application that allows you to take a full-body selfie, receive an AI-generated prediction of your lean future self based on insulin and metabolic control, track your metabolic progress, and receive a personalized transformation timeline. The Service is currently in pre-launch and available through a waitlist and presale program.

3. Eligibility

You must be at least 16 years old to use the Service.
By using MetaFy, you represent that you meet this age requirement.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Waitlist & Presale

Joining the waitlist is free and requires a valid email address. You will receive a confirmation email to verify your subscription (double opt-in).
Waitlist members receive a 25% launch discount when the app launches.
The presale offers a limited number of 999 lifetime accounts at $99 USD (one-time payment). Lifetime accounts include all current and future features of MetaFy with no recurring subscription fees.
Presale purchases are processed through Stripe. By purchasing, you agree to Stripe’s Terms of Service.
Lifetime accounts are non-transferable and limited to one per person.

5. Refund Policy

Presale lifetime account purchases are eligible for a full refund within 14 days of purchase if the app has not yet launched.
After the app launches and you have accessed the Service with your lifetime account, refunds are at our discretion.
To request a refund, email support@metafynow.com with your purchase email and Stripe receipt.

6. Health Disclaimer

MetaFy is not a medical device and does not provide medical advice. The AI-generated body transformation predictions, metabolic timelines, and health insights are for informational and motivational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before starting any diet, exercise, or health program.
AI predictions are estimates based on metabolic science models and may not accurately reflect your individual results.
If you have or suspect a medical condition, seek immediate medical attention.
MetaFy is not responsible for any health outcomes resulting from following the app’s suggestions.

7. Your Data & Content

You retain ownership of all photos and data you upload to MetaFy.
You grant us a limited license to process your photos and data solely to provide the AI transformation and metabolic tracking features of the Service.
We do not sell your personal data or health information to third parties.

8. Acceptable Use

You agree not to:

Upload content that is illegal, harmful, or violates the rights of others
Attempt to reverse-engineer, decompile, or extract the source code or AI models of the Service
Use the Service to generate content that is misleading, defamatory, or harmful
Attempt to bypass rate limits, security measures, or access controls
Resell, redistribute, or sublicense access to the Service
Use automated tools (bots, scrapers) to access the Service without written permission

9. Third-Party Services & Tracking

To operate and improve the Service, we integrate the following third-party tools. By using the Service, you acknowledge the data practices described below.

Google Ads (Google LLC) — We use Google Ads conversion tags to measure the effectiveness of our advertising campaigns. Google may collect your IP address, device identifiers, and browsing behavior through cookies. You can opt out via Google Ads Settings. Google Privacy Policy.
PostHog (PostHog, Inc.) — We use PostHog for product analytics, funnel analysis, and session recording. PostHog captures usage events, page views, and session replays (with sensitive inputs masked) to help us improve MetaFy. PostHog Privacy Policy.
Stripe (Stripe, Inc.) — We use Stripe for secure payment processing. Stripe Privacy Policy.
Resend — We use Resend for transactional email delivery (waitlist confirmation, purchase receipts).

Where required by law, we obtain your consent before activating non-essential tracking technologies. See our Cookie Policy for details.

10. Intellectual Property

The MetaFy name, logo, Meta Lizard mascot, website design, AI models, and all related intellectual property are owned by MetaFy and its licensors. You may not use our trademarks, logos, or branding without prior written permission.

11. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. MetaFy is currently in pre-launch; features and timelines are subject to change.

12. Limitation of Liability

To the maximum extent permitted by law, MetaFy and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, health outcomes, revenue, or profits. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

MetaFy is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Termination

We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request a data export before account deletion by contacting support@metafynow.com.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on our website. Continued use after changes constitutes acceptance.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law provisions. Where applicable, the laws of the State of Delaware shall apply as the default state law.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the federal or state courts located within the United States. You consent to the personal jurisdiction of such courts.

Nothing in this section limits any rights you may have under applicable mandatory consumer protection laws in your country of residence.
